Terms Overview
Ecotech Energy Pty Ltd (“Ecotech Energy”) makes this website (“Our Service”) including all information, documents, communications, files, text, graphics, software, and products available through Our Service (collectively, “Material”) and all services operated by Ecotech Energy and third parties (“collective Services”) through Our Service, available for your use subject to the terms of this agreement (“Terms Of Use”).
General
The Terms of Use and other rules, guidelines, licences and disclaimers posted on Our Service constitute the entire agreement between Ecotech Energy and you with respect to your use.
Acceptance of Terms
By accessing or using Our Service in any way, including, without limitation, use of any of the Services, downloading of any Material, you agree to and are bound by the Terms of Use.
Our Service presents information, news, media and other materials and services, communications, transmissions and other items, tangible or intangible, which are referred to as “Material”. The law applicable to the use of the Material and to disputes arising out of the Material is the state of Victoria, Australia.
We may change this Agreement at any time and you can read a current copy of this Agreement at any time by selecting the “Terms of Use” link at the bottom of each page. If any change is not acceptable, you must discontinue your use immediately; using Our Service after the date that this Agreement changes means you accept the changes.

Limitations of Liability
Subject to any applicable law to the contrary which cannot be excluded, you agree to indemnify and keep indemnified Ecotech Energy and all of its officers, employees, agents, related parties and associates against losses or damages incurred by you in relation to your reliance on our Material.
If you are dissatisfied with the Material or Our Service or with these Terms of Use, your sole and exclusive remedy is to stop using the Material and Our Service.
Under no circumstance will Ecotech Energy be liable for any incidental, special or consequential damages, including damages for loss of business or other profits arising in relation to the Material. We are not and will not be a party to any transaction between you and any third party, whether or not that third party’s material is linked from our service.
Use and Protection of Accounts
You are responsible for maintaining the confidentiality of your account number, name, and/or password (collectively “Account Details”) with EcotechAi??Energy, if applicable. You are responsible for all damages resulting from all uses of your Account Details, whether actually or expressly authorised by you, unless access to your Account Details was obtained through no fault or negligence of your own.
Trademarks
All trade names, trademarks, service marks and other product and service names and logos on Our Service or in the Material are the proprietary trademarks of their respective owners and are protected by applicable trademark and copyright laws.
Copyright
The Third Parties retain all rights and remedies available to them under the Copyright Act 1968. You must not use any of the Material provided by Our Service or any Third Parties for the purpose of replication, distribution or resale other than as permitted under this Agreement.
Ecotech Energy grants you permission to do the following with Material, unless otherwise indicated:
store a reproduction of Material on your local computer for the sole purpose of viewing; or
print hard copies of Material for informational, non-commercial use;
reproduce of complete Material with this copyright notice evident in its entirety in each copy made and distributed
The copyright owner reserves all other rights.
Privacy Amendment (Private Sector) Act 2000
In December 2000, the Commonwealth Government of Australia enacted a further privacy legislation, to commence on the 21st December 2001. This privacy legislation was drafted in order to amend the Privacy Act 1988 (implementing the National Privacy Principles) and to include provisions that regulate the way private sector organisations collect, use, disclose, keep secure and provide access to personal information.

What is personal information?
The Privacy Act 1988 (Cth) defines personal information as information or an opinion about an individual whose identity is apparent or can reasonably be ascertained. It includes your name, age and contact details as well as your financial and health information. Ecotech Energy is bound to protect your personal information in accordance with the National Privacy Principles to the extent required by the Privacy Act 1988.
Collection of personal information
The types of information we keep on record will depend on the product or service requested by you.
How do we collect information?
We collect and store information about you when you:
directly when you provide information by phone or in documents such as application forms
from publicly available source of information
complete any online application of other type of form
provide us with your email address
access and use any of our online services
What information do we hold?
In general, Ecotech Energy keeps a record of one or more of the following types of information:
information that identifies you, such as your name and address and other information provided by you
if you participate or transact in any online service, all details are recorded and stored
We also collect statistical data from all visiting traffic through our website. This data includes information regarding:
the number of visitors
the time and duration of your visit
the information requested during your visit
your browser type
your operating system type
advertisements click throughs (i.e. if you clicked on one of our online advertisements)
the site you came from and exited to
All statistical information is used on aggregate to provide Ecotech Energy with general information about our users and to help promote and better our understanding of the way you use and interact with our online services.
Choice and consent
What are your rights?
There is no legal obligation for you to provide us with any personal information. However, without that information, we may not be able to process your application, fulfill your request or provide you with an appropriate level of service.
Do I have to provide consent?
The main purpose of Ecotech Energy collecting your personal information is to provide, maintain and inform you of our products and services. The terms of our services are detailed in the agreements acknowledged upon any transaction with Ecotech Energy. With any online transactions, by accepting our User Agreement and Privacy Policy, you explicitly consent to the way we use your personal information.

Personal information security
We take all reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification or disclosure.
We have physical, electronic and procedural safeguards to protect your information which is held by us. All online information is stored in electronic database requiring appropriate user authentication for access and is physically stored in secured data-houses located in the Australia. We also may have records stored overseas as a backup. All access to information stored electronically is restricted to Ecotech Energy staff whose job purpose requires access.
Our security measures include, but are not limited to:
restricting access to our computer systems and physical records to authorised persons and preventing users from accessing information they have no need to access
requiring employees to use unique passwords to gain access to systems
these passwords are changed regularly
data encryption with all online transactions
data servers are protected by firewalls and virus scanning tools
Are my online transactions secured?
We provide the maximum level of security when you use our online products and services. All sensitive transactions involving personal information are encrypted using the highest level of encryption (i.e. 128-Bit Encryption using Versign Certificates) meaning you can be assured your information is safe and secure during transit. However, “perfect security” does not exist online.
When do you destroy my information?
We take all reasonable steps to destroy your information in an effective, secure way when it is no longer required by Ecotech Energy. Usually, we keep records for at least five years.
Personal information integrity
We try to ensure that all information we hold about you that we collect, use or disclose is complete, accurate and up to date. We strongly recommend that you:
let us know if there are the information we hold is not accurate, complete or up to date
keep us up to date with changes to the information we hold
We ask that you inform us within a reasonable period, by email at info@ecotechenergy.com.au if you require your information to be updated.
Our disclosure of your information
As a matter of policy, we do not sell any information about you to any third parties. We also do not believe in spamming people with unwanted information. We never disclose any personal information without your written consent. Usually we must get your consent before we tell anyone about you, your accounts or credit information. You can give us your consent expressly or it may be implied by your conduct. The primary purpose of any personal information recorded is to provide you with a better product and/or service.
External Service Providers
We may disclose your personal information to our external service providers (that may be located overseas) that provide services to us. This is on a confidential basis.
Legal Requests
Ecotech Energy may lawfully disclose your information if required to do so for law enforcement or regulatory purposes. For example, we may need to give your account information to the court if we are ordered to do so under a subpoena.
Access to Personal Information
You can request access to your personal information at any time. We will process your requests within a reasonable time, usually 14 days for a straightforward request. More time may be needed, depending on the nature of the request.
There is no fee for requesting access to your personal information from Ecotech Energy; however we may charge you the reasonable cost of processing your request.
Referral program terms and conditions
Ecotech Energy offers a Referral Program for current and previous clients. This program offers a referral fee for successful commercial solar installations that are introduced by previous commercial solar clients. A referral fee will be paid to the party that introduces a new customer to, and where a commercial solar system is installed by Ecotech Energy. The final referral fee will be based on system size, cost and location.
All referral fees will be agreed upon by both parties prior to payment. No part of the referral fee may be used to discount or offset the installation cost of any new system. To be eligible for a referral fee, the new installation must be within the Melbourne metropolitan area, and must be a new customer.
A new customer is defined as a company, business, entity, person or property that Ecotech Energy has not previously had contact with, or provided an estimate or quote for solar services.
Ecotech Energy reserves the right to deny any referral claim at its discretion, and to cancel, edit or alter this program at any time.
